Welcome to Winescapes. These Terms of Service (“Terms”) govern your use of our website (https://www.winescapes.nl) and the purchase of our services. By browsing this website or purchasing a service, you agree to be bound by these Terms, our Privacy Policy, and any other relevant policies.
The term ‘WINESCAPES’, ‘us’, or ‘we’ refers to the owner of the website. Our company is registered with the KVK under number 86417738, with VAT number NL004242899B69. The term ‘you’ or ‘the Client’ refers to the user of our website and/or the purchaser of our services.
Article 1: General Terms of Website Use
1.1. The content of this website is for your general information and use only. It is subject to change without notice. 1.2. While we strive for accuracy, neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, or completeness of the information and materials found on this website. You acknowledge that such information may contain inaccuracies, and we expressly exclude liability for any such inaccuracies to the fullest extent permitted by law. 1.3. Your use of any information on this website is entirely at your own risk, for which we shall not be liable. It is your responsibility to ensure that any products, services, or information available meet your specific requirements.
Article 2: Intellectual Property
2.1. This website and its content, including but not limited to the design, text, layout, and graphics, are owned by or licensed to WINESCAPES. Reproduction is prohibited. 2.2. All materials created by WINESCAPES as part of a service, including custom label designs, tasting notes, and strategic documents, remain the intellectual property of WINESCAPES unless otherwise agreed upon in writing. Clients are granted a license for use as specified in the service agreement.
Article 3: Service Agreement & Booking Process
3.1. All services are offered subject to a formal proposal or quote provided by WINESCAPES. 3.2. A booking is considered confirmed only upon written acceptance of the proposal by the Client and receipt of the required deposit payment as outlined in the invoice.
Article 4: Payment Terms
4.1. A non-refundable deposit of 50% of the total estimated fee is required to confirm and secure the date for any private event, consultancy service, or journey. 4.2. The final balance is due no later than 14 days prior to the scheduled event or service delivery date, unless otherwise specified in the invoice. 4.3. Payments for public, ticketed events (e.g., Masterclasses) are due in full at the time of booking. 4.4. WINESCAPES reserves the right to charge interest on any overdue payments.
Article 5: Cancellation and Rescheduling Policy
5.1. Cancellation by the Client (Private Events, Consulting, Journeys): - More than 30 days prior to the event: The deposit may be refunded or applied to a rescheduled date. - 15 to 30 days prior to the event: The 50% deposit is forfeited. - Less than 14 days prior to the event: The Client is liable for 100% of the total service fee. 5.2. Cancellation by WINESCAPES: If WINESCAPES must cancel for any unforeseen reason, the Client will be offered the choice of a full refund of all amounts paid or rescheduling the service at a mutually agreeable date. 5.3. Changes in Guest Count (Private Events): The final guest count must be confirmed no later than 7 days prior to the event. The final invoice will be adjusted accordingly. Decreases in guest count within 7 days of the event will not be subject to a refund.
Article 6: Service-Specific Terms
6.1. Public Wine Tastings & Masterclasses: You may cancel free of charge up to 48 hours before the event for a full refund. Cancellations made less than 48 hours before the event are non-refundable. 6.2. Corporate & Private Events (Hospitality, Business, Celebrations): The Client is responsible for providing a suitable and safe venue, including any necessary licenses. The Client is also responsible for the conduct of their guests. 6.3. Winescapes Journeys: WINESCAPES acts as an agent in arranging services with third-party suppliers (e.g., wineries, hotels, transportation). We are not responsible for any failure or default on the part of these suppliers. We strongly recommend all participants acquire comprehensive travel insurance. Itineraries are subject to change due to unforeseen circumstances. 6.4. The Winescapes Collective: This is a recurring service. Cancellation requires written notice at least 30 days prior to the next scheduled shipment and billing date.
Article 7: Limitation of Liability
To the fullest extent permitted by law, WINESCAPES shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim arising out of our services shall not exceed the total amount paid by the Client for the service in question.
Article 8: Governing Law & Dispute Resolution
Your use of this website and any dispute arising from it, as well as all service agreements, are subject to the laws of The Netherlands. Any disputes will be resolved in the competent court in Amsterdam.
